Selling an inherited Texas vehicle

Probated estate or heirship route?

VTR-262 explains that an executor or administrator may assign a title with the required certified probate documents. Where no estate administration has occurred and none is necessary, the heirship form may be applicable instead.

Identify the required heirs

Read the form’s surviving-spouse, children and minor-heir instructions. The required signers depend on the family circumstances. Do not assume that the person holding the keys can act for all heirs.

Complete the notarized certification

The heir certification must be notarized and cannot be executed through a power of attorney. Additional copies can be used when the required heirs cannot attend the same notary together; submit the complete set.

Gather the transfer documents

Use the form’s checklist for Form 130-U, lien releases and any applicable court or out-of-state record. Resolve signing authority before confirming collection and the payment recipient.
