G.S. 20-77(b) provides for transfers using estate documents such as a certified probated will, letters of administration or a clerk’s certificate assigning the vehicle as a spousal year’s allowance. A limited all-heirs affidavit route also exists under specified conditions. Ask the clerk which route applies to this estate.
What does the Mecklenburg affidavit packet require?
The Mecklenburg County MVR-317 instructions apply to residents of that county at death. Conditions include agreement by all heirs, no will offered for probate, combined vehicle value no greater than $5,000, and paid funeral expenses with contributors’ consent. The sample cannot be filed; obtain the actual form from the clerk. Other counties must confirm their own process.

Identify who will sign and release the car. Share that arrangement with the purchasing partner before pickup and retain the court and sale records together.
