Do both owners need to sign a New York title?
New York DMV says that when a vehicle has multiple owners, one owner’s signature is sufficient to transfer its title. This is the New York title rule; do not assume it governs a title issued by another state. A disputed ownership interest, court order or estate issue needs separate resolution.
Is the registered driver necessarily an owner?
The title and registration can name different people. DMV distinguishes ownership from permission to register a vehicle. Check the ownership document rather than relying on whose name appears on the insurance card or who normally drives the car.
What if there are three or more owners?
DMV retains additional owners in its electronic records even though only the first two appear on the title. Tell the buyer about all ownership interests and resolve any uncertainty with DMV before pickup.
What should we agree before collection?
Agree who will meet the driver, sign the documents and receive payment. Keep the agreement with the sale records. If an owner has died, use the deceased-owner process instead of assuming that possession of the car authorizes the sale.
