Which paperwork route applies?
Use DMV’s deceased-owner checklist, MV-843. The required documents depend on the ownership record, estate administration and the eligible survivor. Possessing the keys or storing the car does not establish authority to sign its title.
Can every heir use the same affidavit?
DMV distinguishes estate-representative transfers from qualifying family transfers. MV-349 and MV-349.1 are not interchangeable shortcuts. For an out-of-state title in a deceased owner’s name, DMV says those affidavits cannot be used; its instructions describe executor or administrator documentation.
What should I tell the buyer?
Explain whose name appears on the ownership document and who is handling the estate. Gather the applicable court papers, death record and ownership documents before agreeing handover. If authority is disputed, resolve it with the estate representative before signing a sale.
