Odometer disclosure when selling a New York car

Record mileage accurately and check the model-year exemption before completing the transfer.

Which cars need mileage disclosure?

DMV’s dealer regulations exempt model-year 2010 and older vehicles. For model-year 2011 and newer vehicles, the exemption applies at 20 model years; vehicles 19 model years old or less remain subject to disclosure. Do not apply the old ten-year assumption to a newer car.

What if the title has no disclosure section?

DMV provides MV-103 for the applicable odometer and damage disclosures when the ownership document lacks the required section. Both seller and buyer complete their required portions. A mileage exemption does not erase a separate damage-disclosure requirement.

What if the odometer is broken?

Do not invent a mileage figure or describe an uncertain reading as actual mileage. DMV distinguishes an odometer that has exceeded its mechanical limit from a reading that does not reflect actual mileage. Explain a replacement, failure or discrepancy to the buyer before signing.

How should I prepare the vehicle details?

Photograph the displayed reading if it can be accessed safely, and gather records for any instrument replacement. Tell the buyer what you know and what remains unknown. Keep the completed disclosure with your sale documents.
