What does retaining the car mean for paperwork?
Section 1161(b) requires an owner who retains a vehicle damaged enough to qualify for vehicle replacement payment to apply immediately for a salvage certificate. The settlement and ownership documentation need to agree. Ask the insurer to explain whether it takes the vehicle or leaves it with you.
What should you compare before accepting a settlement?
Ask the insurer for the settlement calculation, any retention deduction, lender payment and the documents needed for either option. These amounts depend on the claim; a junk-car quote is not an insurance valuation. Confirm any lender’s involvement before committing the vehicle to another purchaser.
Can you sell while the vehicle is in storage?
Tell the buyer where the vehicle is held and ask the facility who can authorize release. Establish whether the insurer has already taken ownership or instructed removal. Resolve the release arrangements and any existing charges separately from the free towing included in a purchase.
What should you keep after the sale?
